An accomplished and experienced litigation attorney, Martin Amaro focuses on complex antitrust, intellectual property, and commercial litigation.

Martin has represented clients in a variety of complex antitrust actions involving claims of price fixing, market allocation, and monopolization in various industries, such as agriculture, pharmaceuticals, and retail products. A creative and multidimensional thinker with strong analytical skills and great attention to detail, Martin is a valued member of litigation and trial teams handling complex cases.

Early in his career, Martin worked for a patent litigation boutique where he helped domestic and foreign entrepreneurial ventures protect, leverage, and enforce their intellectual property rights. His cases have involved diverse technologies, including computer hardware, consumer electronics, communications, medical devices, e-commerce, semiconductors, social networking, and software. He applies the knowledge and experience gained in that role now, especially to antitrust disputes involving aspects of patent law.

Fluent in German and English, with U.S. and German law degrees, Martin skillfully navigates United States and German legal systems and business cultures.

Representative Matters

Served on the litigation team representing several large grocers and other large purchasers in antitrust litigation against the country’s largest chicken producers based on violations of the Sherman Act arising from coordinated efforts by the producers to restrict output and inflate prices. We litigated the case for over five years, defeating numerous summary judgment and other case dispositive motions along the way. The matter resulted in numerous favorable settlements for our clients prior to trial. In re: Broilers Antitrust Litigation, Case No. 1:16-cv-08637 (N.D. Ill.).  

Member of the litigation team that secured a $454 million settlement for direct purchasers of the drug Glumetza. The case involved allegations that direct purchasers of the pharmaceutical product Glumetza overpaid for the drug as a result of a payoff to potential generic competitors. In re Glumetza Antitrust Litigation, 19-cv-6156 (N.D. Cal.). 

Represented a class of app developers and helped secure a $100 million settlement with Apple Inc., including going forward-rate relief for app developers in a lawsuit alleging that Apple violated U.S. antitrust and California unfair competition laws by monopolizing (or attempted to monopolize) an alleged iOS app and in-app product distribution services market, and charging supracompetitive fees to app developers by restricting their access to payment options. In re Apple iPhone Antitrust Litigation,4:11-cv-06714 (D. Cal.)  and Cameron v. Apple, 4:19-cv-03074 (N.D. Cal.).

Was an integral member of a litigation team that secured a $340 million settlement for direct purchasers of certain of Ranbaxy, Inc.’s generic drugs. The case alleged violations of RICO, federal and state antitrust laws, and consumer protection laws claiming Ranbaxy improperly conspired to defraud U.S. regulatory authorities into giving the company certain regulatory exclusivities to produce generic versions of Novartis AG's blood pressure drug Diovan, Pfizer's acid reflux medication Nexium and Genentech's antiviral drug Valcyte. Meijer, Inc. v. Ranbaxy Inc., 15-cv-11828 (D. Mass.).

Representing a group of direct purchasers of insulin glargine (Lantus®) in an antitrust lawsuitagainst Sanofi for allegedly delaying competition for more affordable alternatives for Lantus insulin injectables by improperly submitting multiple patents for listing in the FDA’s Orange Book directed at insulin injector pens even though these patents do not also claim the active pharmaceutical ingredient of the FDA-approved drug. In re Lantus Direct Purchaser Antitrust Litigation , 1:16-cv-12652 (D. Mass.).
