Defended a real estate development and management firm in a class action suit naming it along with other rental property owners over the enforceability of the notice provisions in their residential leases, swiftly negotiating a global settlement for all defendants on favorable terms. Secured dismissal on jurisdictional grounds for the defendant law firm facing a class action suit seeking to hold it liable for the unrelated actions of the firm’s former client’s alleged fraud. Koock v. Sugar Felsenthal, LLP, 8:09-CV-609-T-17EAJ, (M.D. Fla).
Served as a team member representing merchants and retailers as “opt-outs” from several large antitrust cases. Our team was able to secure more favorable settlements and relief for our opt-out clients than has been available to the general class action members:
- Helped represent a group of grocery store chains that had been paying inflated prices for eggs because of the egg farming industry’s practices to limit egg supply. Our team achieved favorable settlements from many of the largest egg producers in the nation. In re: Processed Egg Products Antitrust Litigation, Case no. 08-MD-2002 (E.D. Pa.).
- Helped represent a group of grocery store chains that had paid inflated prices for prepackaged tuna fish resulting from an international conspiracy to control prices by major seafood fishing and processing firms. In re: Packaged Seafood Antitrust Litigation, Case No. 3:15-md-2670-JLS-MDD (S.D. Cal.).
Helped represent a variety of major retail chains, as opt-outs from one of the largest antitrust cases in history, suing Visa, Mastercard, and American Express over the credit card giants’ policies designed to keep swipe fees paid by merchants high and discourage competition between credit cards at the point of sale.
