Scott Perwin represents clients in antitrust matters, other commercial disputes, and bet-the-company litigation at trial and on appeal. With decades of experience, Scott has achieved successful results based on his clients’ litigation objectives and business goals.

Renowned in antitrust, Scott has been named Best Lawyers in America’s “Lawyer of the Year” for Miami six times in either Antitrust Litigation or Antitrust Law.

Scott’s work primarily focuses on the plaintiffs’ side, helping clients recover overcharges paid as a result of price-fixing cartels or unlawful exclusion of competition. Scott has represented plaintiffs in a number of generic pharmaceutical exclusion cases, including many high-profile pay-for-delay cases. He filed an amicus brief supporting the Federal Trade Commission in the Supreme Court case of FTC v. Actavis.

He is a member of the ABA’s Antitrust Section and was a founding member of the Antitrust and Trade Regulation Law Certification Committee of the Florida Bar.

Representative Matters

Has successfully prosecuted approximately 25 antitrust cases against pharmaceutical manufacturers for engaging in unlawful efforts to delay generic competition.

Obtained a reversal by the U.S. Court of Appeals for the Third Circuit of an adverse ruling on an important issue regarding anti-assignment provisions in commercial supply contracts.

Obtained an $8 million settlement in antitrust and constitutional litigation against the City of Key West on behalf of a small amphibious tour operator.

Was responsible for several successful state court appeals raising issues under the Florida Antitrust Act of 1980.
